Terms of Use

Please read these Terms of Use ("Terms") carefully. They are a legal agreement between you and Golf Better ("we", "us", "Golf Better") governing your use of the Golf Better mobile application (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. The Service

Golf Better is a mobile application for golf scoring, handicap calculation, friendly "skins" record-keeping, optional multiplayer round synchronization, a shared community course database, and on-device scorecard scanning. Most of your data is stored locally on your device; cloud-based features are optional and require you to sign in.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the App on devices you own or control, for your personal, non-commercial use. You may not copy, modify, translate, reverse-engineer, decompile, or create derivative works of the App, nor rent, lease, lend, sell, redistribute, or sublicense it, except as permitted by applicable law. All rights not expressly granted are reserved by us.

2. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms.

3. Your Account

Creating an account (via Google, Apple, or email) is optional and required only for social and cloud features such as multiplayer, friends, the community course database, and cloud backup. You are responsible for the accuracy of the information you provide and for activity under your account. You may delete your account and its associated cloud data at any time from within the App.

4. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose; (b) submit false, misleading, or infringing course data; (c) harass, abuse, or impersonate other users; (d) attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the App or its services; or (e) misuse the community course database, including spamming or uploading data you do not have the right to share.

5. User Content and Community Courses

When you contribute course data while signed in, that data is shared with other users through the community course database. You grant Golf Better a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that data to operate and improve the service. You represent that you have the right to share any data you submit. We may review, modify, validate, or remove community content at our discretion.

6. Skins, Wagers, and No Money Handling

Golf Better is a score-tracking and record-keeping tool only. It does not facilitate, process, host, or handle gambling, wagering, or any monetary transaction of any kind. Any stakes, bets, or financial arrangements between players are made entirely at your own discretion and risk. You are solely responsible for ensuring that any such arrangements comply with all laws applicable to you. Golf Better and its developers accept no liability for any financial arrangements made between users of the App.

7. Handicap and Course Information

Any handicap figures the App displays, including the Handicap Tracker, are unofficial estimates provided for personal tracking only. They are not official Handicap Index values issued under the World Handicap System or by any authorized golf association. Course data, ratings, slopes, and scanned values may contain errors. You are responsible for verifying any information before relying on it.

8. Subscriptions and Billing

Some premium features may require a paid subscription. Where offered, subscriptions are sold and billed through the Apple App Store or Google Play and are subject to their terms. Subscriptions automatically renew until canceled. You can manage or cancel a subscription at any time in your App Store or Google Play account settings. All payments are processed by the applicable app store; Golf Better does not collect, process, or store your payment information.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect, how it is used, and your rights.

10. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that handicap calculations, course data, or scan results will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Golf Better and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any financial arrangements between users, arising out of or related to your use of the App. Our total liability for any claim will not exceed the greater of the amount you paid for the App in the prior twelve months or USD 10 dollars.

12. Indemnification

You agree to indemnify and hold harmless Golf Better and its developers from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access if you violate these Terms or misuse the service. You may stop using the App and delete your account at any time. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the Effective Date above. Continued use of the App after the changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-laws rules. Any disputes will be subject to the state and federal courts located in South Carolina, except where applicable law provides otherwise.
